Thank you for taking my quote out of context... I never said that titles must have region specific coding. I've imported games for years and never owned a foreign system. Like I said, I was hypothesizing as to why they might not want to issue a statement on whether or not the game would run on another region's console.
Aksys is a publisher not a developer. So what happens if they, or another like company, license a game for this region and someone else acquires the rights for a PAL release? Now let's run with this scenario for a second; imagine Publisher A were scheduled to release Game X a week, a month or even a year before Publisher B can get it out in their region. Furthermore, Publisher A announces that their release will be region free and/or markets the game to other regions. Now I'm not familiar with the legal stipulations used when a publisher signs a deal with a developer to localize their game, but I doubt they have carte blanche over the IP. A scenario such as the one described would A) probably breach their contract, B) possibly violate directives that regulate international commerce thus resulting in a civil lawsuit, C) preclude any future business dealings between the publisher and developer, and, D) make the offending company look bad to their peers in the industry.
Now I'm not saying nor have I ever thought that Agarest for the 360 does not stand a chance to be a region free disc. In fact, I'm all for it being region free because I play imports and think anyone who wants to play this game in English for the 360 should be allowed to. The point of my original post was that people need to realize that this issue may not be as simple as it has been made out to be. It is not the same as Dead Rising, a game both developed and published by Capcom. When multiple parties are involved in different regions across the globe the situation is much more complicated...
