I makes no sense a japanese version and an US version on market leaving not only the european gamers outside, but also brazilians gamers like me that have a PAL console !! :(

I don't see why they would not enable PAL.
Pretty much every country uses PAL except North America, some south american countries, Korea and Japan.
Rest of the world are PAL.
Aksys please unlock pal region, you can keep ntsc-j locked due to them already having a official relase.

We don't have the rights to publish Deathsmiles in Europe. As far as I know, it would be very possible for a European publisher to publish the game. I'd recommend e-mailing your favorite publisher in your home country, and suggest they acquire the Deathsmiles license. Wish I could help you more. :(
Asada's wish was for everyone to enjoy shooting games "in the west". That's why he made Futari and Galuda 2 region free. The last I heard, the west wasn't solely restricted to America.
Apparently Aksys have decided to go against Cave's wish, as this could not have been a decision from the developer.

Here is an excerpt from an interview Siliconera did with the man himself and here is his statement:
Mushihime-sama Futari was our first region-free game and we were happy enough with the response to finalize our plans for the US release of Deathsmiles. Ultimately, releasing the game region free doesn’t make as much sense to us as localizing our games and building a real fanbase overseas. That doesn’t mean that we’re only going to release games in the US of course, it really depends on interest from fans.
Remember, it was Aksys who had asked Cave, not the other way around.

But, don't get discouraged. If this thread is any indication it shows that there is an interest from fans as Asada had wanted. Now, the best there is to do, as what Ben said, is to contact your locale/favorite publisher and drum up support. Get the word out there and see where it goes. The worst you can do is not try.

Just to be completely clear, is this region locked to America only and will not playable on a japanese machine?
I know I'm clutching at straws here, but I'd love to play an English localised version on my JP360, not to mention having MBL and bug fixes on the disk (and the faceplate and the US$50 price tag!)

Region locking the localized version of DS makes no sense, as the majority of people who have wanted to play the game by now have already taken steps towards a Japanese 360 and the game, and there's little incentive for them to support a localized release if it won't work on their console.
Localizing this into Europe is going to take even longer, considering that 1) Japanese 360 users will be getting DS2 before America even sees the first game and 2) making the game region free or compatible with PAL consoles is nowhere near as difficult as people seem to believe, and making it region free would actually profit Aksys in the long run.
I understand Aksys' intentions with their LEs; very stylized Agarest, BlazBlue and now DS LEs coming out, but discarding potential buyers from an international standpoint is just ignorant. Remember when nobody knew about Aksys? Remember when it was 2 years ago? Beggars can't be choosers.
No offense Belisarius, but you seem to know very little of how the 360's coding works. This is evident by the Agarest thread, where you said Agarest will work on Asian 360s, yet not Japanese 360s. This has never happened before, wherein only differentiating between <i>versions</i> released in both Asia and Japan have been seen.
For instance, Asia's Fallout 3 has an area with a nuke, however the Japanese version does not. But these are both NTSC-J, and they will work on a console whether purchasd in Hong Kong, or Tokyo. So it isn't a matter of "will it work" but rather, "confirming Asian 360s are compatible also confirms JP 360s as compatible".
Following that, I will be buying Agarest by my own knowledge. I know I won't be purchasing the North American Deathsmiles LE if it isn't compatible with Japanese 360s, but so far, Aksys' releases have now followed a trend.
If potential PAL buyers have to decide between an American 360 and a Japanese 360, which do you think they will choose? They will of course choose a JP 360, not only because it eliminates the region issue but they'll also receive their games months, or in Deathsmiles' case, years before their localization. And if Aksys' releases ignore both of those regions, just to cater to the "US fanbase", they're just cutting off their nose to spite their face, aren't they?
